Initialyze also provides consulting, implementation, managed services, and other professional services. Those services may be governed by separate agreements, statements of work, or order forms. If a separate agreement conflicts with these Terms, the separate agreement controls for those services.
By accessing or using a service covered by these Terms, you agree to them and to our Privacy Policy.
1. Our Services
Initialyze develops and provides technology solutions, professional services, software products, platforms, and AI-enabled applications.
Our services may include:

- software products and platforms;
- artificial intelligence features;
- integrations with third-party services;
- messaging and communication features;
- consulting and professional services; and
- other technology solutions we may introduce.
Features and functionality may change over time.
2. Accounts and Eligibility
Some services require an account.
You agree to:

- keep your login credentials secure;
- promptly notify us of suspected unauthorized access; and
- be responsible for activity occurring through your account.
You may not use another person's account without authorization.
Our consumer services are intended for users who are at least 18 years old , unless we expressly state otherwise.
3. BotYourself and AI-Enabled Services
BotYourself is an AI-powered assistant that can help users find information, communicate, manage tasks, receive reminders, interact with connected services, and perform other user-directed activities.
Other Initialyze services may also use artificial intelligence.
AI systems are probabilistic and may occasionally generate information that is inaccurate, incomplete, outdated, or inappropriate for your circumstances.
You are responsible for evaluating AI-generated information before relying on it.
Our AI-enabled services are not a substitute for professional medical, legal, financial, tax, or other regulated professional advice.
Where a service can perform an action on your behalf, you are responsible for:
- the instructions you provide;
- the permissions you grant;
- reviewing actions when confirmation is requested; and
- ensuring you have authority to perform the requested action.
4. Connected Services
Some Initialyze products may allow you to connect third-party services such as email, calendars, cloud storage, productivity tools, messaging platforms, or other applications.
By connecting a service, you authorize Initialyze to access and use information from that service as reasonably necessary to provide the functionality you request or enable.
You are responsible for the permissions you grant.
You may revoke access through the applicable Initialyze product or through the third-party provider where supported.
Third-party services remain subject to their own terms, policies, availability, and functionality. Initialyze is not responsible for third-party services we do not control.
5. SMS and Mobile Messaging
Certain Initialyze products, including BotYourself, may offer SMS or other mobile messaging features.
If you choose to enable SMS messaging, you consent to receive messages related to the services you request. These may include:
- AI assistant responses;
- reminders;
- task and activity updates;
- confirmations;
- account notifications; and
- other informational messages related to features you enable.
Message frequency varies. Message and data rates may apply.
Consent to receive SMS messages is not a condition of purchase .
You may opt out of SMS messages at any time by replying STOP .
Reply HELP for assistance.
Carriers are not responsible for delayed or undelivered messages.
You are responsible for providing a mobile number that belongs to you or that you are authorized to use.

6. WhatsApp and Other Messaging Services
We may allow you to interact with Initialyze services through WhatsApp or other third-party messaging platforms.
Your use of those platforms is also governed by the applicable provider's terms and privacy policies.
Availability and functionality may depend on those providers and may change without notice.
7. Your Content and Information
You retain ownership of the content and information you provide to our services.
You give Initialyze permission to process, store, transmit, and otherwise use that content only as reasonably necessary to provide, secure, operate, maintain, and improve the applicable services , subject to our Privacy Policy and any separate agreement with you.
You are responsible for ensuring that you have the right to provide any content or information you submit.
8. Acceptable Use
You may not use our services to:
- violate any applicable law or regulation;
- commit fraud or engage in deceptive activity;
- send spam or unauthorized communications;
- harass, threaten, or harm another person;
- impersonate another person or organization;
- infringe intellectual property, privacy, or other rights;
- distribute malware or malicious code;
- gain unauthorized access to systems, accounts, or data;
- interfere with or disrupt our services;
- circumvent security or usage restrictions;
- use our services to facilitate unlawful or harmful activity; or
- misuse automated or AI features in ways that create unreasonable risk to Initialyze, our users, or others.
We may investigate suspected misuse and take reasonable action to protect our services and users.
9. Intellectual Property
Initialyze and its licensors retain all rights in our:
- software;
- platforms;
- websites;
- designs;
- trademarks;
- branding;
- documentation;
- technology; and
- other proprietary materials.
Except for the limited right to use our services under these Terms, no intellectual property rights are transferred to you.
You may not copy, modify, reverse engineer, sell, sublicense, or distribute our services except where expressly permitted by us or applicable law.
10. Feedback
If you provide ideas, suggestions, or feedback about our services, you allow us to use that feedback without restriction or obligation to compensate you.
This does not give us ownership of your personal content or data.
11. Fees and Paid Services
Some services may require payment.
Pricing, billing terms, subscriptions, usage limits, renewal terms, and cancellation rights may be presented when you purchase a service or included in a separate order form or agreement.
You agree to pay applicable fees and taxes associated with services you purchase.
Unless otherwise stated, fees are non-refundable except where required by law.
12. Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information.
By using our services, you acknowledge that your information will be handled as described in that policy.
13. Service Availability and Changes
We work to provide reliable services, but we do not guarantee that every feature will always be:

You may stop using our services at any time.
Where supported, you may also close or request deletion of your account.

- payment obligations are not satisfied;
- we are required to do so by law; or
- we discontinue the applicable service.
Where appropriate, we will make reasonable efforts to provide notice.
Sections that by their nature should survive termination will continue to apply.
15. Disclaimers
To the extent permitted by law, our services are provided “as is” and “as available.”
We do not guarantee that:
- services will always be uninterrupted or error-free;
- AI-generated information will always be accurate or complete;
- third-party integrations will remain available; or
- a service will meet every particular requirement or outcome.
Nothing in these Terms limits warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, Initialyze and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the services.
This includes, where permitted by law, losses relating to:
- profits;
- revenue;
- business opportunities;
- goodwill;
- data; or
- interruption of service.
Initialyze's total liability arising from a consumer's use of a paid online service will not exceed the amount the user paid Initialyze for that service during the 3 months preceding the event giving rise to the claim, unless applicable law requires otherwise.
Liability relating to professional services may instead be governed by the applicable contract or statement of work.
17. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of our services, violation of these Terms, or infringement of another person's rights.
This provision does not apply where prohibited by applicable consumer law.
18. Changes to These Terms
We may update these Terms as our services, business, or legal requirements evolve.
When we make changes, we will update the Last Updated date above.
If a change materially affects your rights, we will provide additional notice where required by law.
Continued use of the services after updated Terms become effective constitutes acceptance of the updated Terms, where permitted by law.
19. Governing Law
These Terms are governed by the laws of Texas, without regard to conflict-of-law principles.
Any disputes will be handled in the courts located in Travis County, Texas, unless applicable law gives you the right to bring a claim elsewhere or another written agreement with Initialyze provides different dispute terms.
20. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights under these Terms without our consent. Initialyze may transfer these Terms in connection with a merger, acquisition, restructuring, or sale of its business or assets.
These Terms, together with any applicable order forms, product-specific terms, and incorporated policies, form the agreement governing your use of the applicable services.
