These Terms of Service (“Terms”) govern your use of websites, software, applications, platforms, products, and other online services provided by Initialyze Inc. (“Initialyze,” “we,” “us,” or “our”), including BotYourself.
BotYourself is a product operated by Initialyze Inc.
Initialyze also provides consulting, implementation, managed services, and other professional services. Those services may be governed by separate agreements, statements of work, order forms, or other written terms. If a separate agreement conflicts with these Terms, the separate agreement controls for those services.
By accessing or using a service covered by these Terms, you agree to these Terms and our Privacy Policy.
1. Our Services
Initialyze develops and provides technology solutions, professional services, software products, platforms, AI-enabled applications, integrations, and communication features.
Our services may change over time, and some features may be added, modified, suspended, or discontinued.
2. Accounts and Eligibility
Some services require an account. You agree to provide accurate information, keep your account credentials secure, and promptly notify us of suspected unauthorized access.
You are responsible for activity occurring through your account and may not use another person's account without authorization.
Our consumer services are intended for users who are at least 18 years old, unless we expressly state otherwise.
3. BotYourself and AI-Enabled Services
BotYourself is an AI-powered assistant that can help users find information, communicate, manage tasks, receive reminders, interact with connected services, and perform other user-directed activities.
Other Initialyze services may also use artificial intelligence.
AI systems may occasionally generate information that is inaccurate, incomplete, outdated, or inappropriate for your circumstances. You are responsible for evaluating AI-generated information before relying on it.
Our AI-enabled services are not a substitute for professional medical, legal, financial, tax, or other regulated professional advice.
Where a service can perform an action on your behalf, you are responsible for the instructions you provide, the permissions you grant, reviewing actions when confirmation is requested, and ensuring you have authority to perform the requested action.
4. Connected Services
Some Initialyze products may allow you to connect third-party services such as email, calendars, cloud storage, productivity tools, messaging platforms, or other applications.
By connecting a service, you authorize Initialyze to access and use information from that service as reasonably necessary to provide the functionality you request or enable.
You are responsible for the permissions you grant and may revoke access through the applicable Initialyze product or third-party provider where supported.
Third-party services remain subject to their own terms, policies, availability, and functionality. Initialyze is not responsible for third-party services we do not control.
5. BotYourself SMS Messaging
BotYourself, a product operated by Initialyze Inc., uses SMS as part of its account and AI assistant functionality.
The BotYourself SMS program is used only for transactional, account-related, assistant, and other functional communications. We do not use the BotYourself SMS program to send marketing or promotional messages.
Initialyze Inc. is the sole sender of BotYourself SMS messages. Initialyze does not send SMS messages on behalf of, or containing content from, any third party, affiliate, lead buyer, or marketing partner. Consent you give for BotYourself SMS applies only to Initialyze Inc.
When you provide your mobile phone number and specifically consent to receive SMS messages from Initialyze Inc. in connection with BotYourself, messages may include:
- account registration and verification codes;
- AI assistant responses;
- reminders;
- task and activity updates;
- confirmations;
- account notifications and alerts; and
- other informational messages related to BotYourself features you use or enable.
Message frequency varies. Message and data rates may apply.
You may opt out of SMS messages at any time by replying STOP. Reply HELP for assistance.
If you opt out of SMS, certain BotYourself features that depend on SMS may no longer be available to you.
Consent to receive BotYourself SMS messages is provided directly to Initialyze Inc. and applies only to communications related to the BotYourself service.
SMS consent is separate from acceptance of these Terms. You may withdraw SMS consent at any time by replying STOP. Withdrawing SMS consent does not terminate your agreement to these Terms, but features that depend on SMS may no longer be available.
Mobile phone numbers, SMS opt-in information, and messaging consent are not sold, rented, shared, or provided to third parties or affiliates for marketing or promotional purposes.
We may provide mobile information to service providers that help us deliver messaging, authentication, security, hosting, or related services, solely as necessary to provide those services on our behalf. These providers are not authorized to use your mobile information or messaging consent for their own marketing or promotional purposes.
Carriers are not responsible for delayed or undelivered messages.
You are responsible for providing a mobile number that belongs to you or that you are authorized to use.

6. WhatsApp and Other Messaging Services
We may allow you to interact with Initialyze services through WhatsApp or other third-party messaging platforms.
Your use of those platforms is also governed by the applicable provider's terms and privacy policies. Availability and functionality may depend on those providers and may change without notice.
7. Your Content and Information
You retain ownership of the content and information you provide to our services.
You give Initialyze permission to process, store, transmit, and otherwise use that content as reasonably necessary to provide, secure, operate, maintain, and improve the applicable services, subject to our Privacy Policy and any separate agreement with you.
You are responsible for ensuring that you have the right to provide any content or information you submit.
8. Acceptable Use
You may not use our services to:
- violate applicable law or regulation;
- commit fraud or engage in deceptive activity;
- send spam or unauthorized communications;
- harass, threaten, or harm another person;
- impersonate another person or organization;
- infringe intellectual property, privacy, or other rights;
- distribute malware or malicious code;
- gain unauthorized access to systems, accounts, or data;
- interfere with or disrupt our services;
- circumvent security or usage restrictions; or
- misuse automated or AI features in ways that create unreasonable risk to Initialyze, our users, or others.
We may investigate suspected misuse and take reasonable action to protect our services and users.
9. Intellectual Property
Initialyze and its licensors retain all rights in our software, platforms, websites, designs, trademarks, branding, documentation, technology, and other proprietary materials.
Except for the limited right to use our services under these Terms, no intellectual property rights are transferred to you.
You may not copy, modify, reverse engineer, sell, sublicense, or distribute our services except where expressly permitted by us or applicable law.
10. Feedback
If you provide ideas, suggestions, or feedback about our services, you allow us to use that feedback without restriction or obligation to compensate you. This does not give us ownership of your personal content or data.
11. Fees and Paid Services
Some services may require payment.
Pricing, billing terms, subscriptions, usage limits, renewal terms, and cancellation rights may be presented when you purchase a service or included in a separate order form or agreement.
You agree to pay applicable fees and taxes associated with services you purchase. Unless otherwise stated, fees are non-refundable except where required by law.
12. Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information.
13. Service Availability and Changes
We work to provide reliable services, but we do not guarantee that every feature will always be available, uninterrupted, error-free, or compatible with every third-party service.
We may modify, suspend, replace, or discontinue features when reasonably necessary. We may also establish reasonable usage limits to protect service reliability, security, or other users.
14. Suspension and Termination
You may stop using our services at any time. Where supported, you may also close or request deletion of your account.
We may suspend or terminate access when reasonably necessary, including if you materially violate these Terms, your use creates a security or legal risk, payment obligations are not satisfied, we are required to do so by law, or we discontinue the applicable service.
Where appropriate, we will make reasonable efforts to provide notice. Sections that by their nature should survive termination will continue to apply.
15. Disclaimers
To the extent permitted by law, our services are provided “as is” and “as available.”
We do not guarantee that services will always be uninterrupted or error-free, that AI-generated information will always be accurate or complete, that third-party integrations will remain available, or that a service will meet every particular requirement or outcome.
Nothing in these Terms limits warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, Initialyze and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the services.
This includes, where permitted by law, losses relating to profits, revenue, business opportunities, goodwill, data, or interruption of service.
Initialyze's total liability arising from a consumer's use of a paid online service will not exceed the amount the user paid Initialyze for that service during the three months preceding the event giving rise to the claim, unless applicable law requires otherwise.
Liability relating to professional services may instead be governed by the applicable contract, statement of work, or other written agreement.
17. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of our services, violation of these Terms, or infringement of another person's rights.
This provision does not apply where prohibited by applicable consumer law.
18. Changes to These Terms
We may update these Terms as our services, business, or legal requirements evolve.
When we make changes, we will update the Last Updated date above. If a change materially affects your rights, we will provide additional notice where required by law.
19. Governing Law
These Terms are governed by the laws of Texas, without regard to conflict-of-law principles.
Any disputes will be handled in the courts located in Travis County, Texas, unless applicable law gives you the right to bring a claim elsewhere or another written agreement with Initialyze provides different dispute terms.
20. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights under these Terms without our consent. Initialyze may transfer these Terms in connection with a merger, acquisition, restructuring, or sale of its business or assets.
These Terms, together with any applicable order forms, product-specific terms, and incorporated policies, form the agreement governing your use of the applicable services.
